ARTICLE 1 – Scope
These General Terms and Conditions of Sale (hereinafter referred to as "the General Terms and Conditions") apply, without restriction or reservation, to all sales concluded between ADEGAS TRAVEL, a company with a simplified share capital of 500 euros, registered in the RCS of Bordeaux under number 927 621 722, whose registered office is at 16 Allée Blaise Pascal, 33470 Gujan Mestras (hereinafter referred to as "the Seller"), and any non-professional buyer (hereinafter referred to as "the Customer"), wishing to acquire the products offered for sale on the website www.adegas-terroirs.com. Featured products include wines, spirits, champagnes, fine grocery products, and oenological services.
ARTICLE 1 BIS – Legal capacity and regulation
Pursuant to article L.3342-1 of the Public Health Code and the Act of 21 July 2009, the sale of alcohol to minors is prohibited. The Customer undertakes to be at least 18 years of age on the date of the order and/or subscription. In case of an order from abroad, the Customer must be of legal age to consume alcohol in his country of residence.
Alcohol abuse is dangerous to health – to be consumed in moderation.
Article 2 – Prices
The prices displayed on the Site are expressed in euros, including all taxes (including taxes). They shall take into account the VAT applicable on the day of the order. The Seller reserves the right to change his prices at any time, but the products are invoiced on the basis of the rates in force at the time of registration of the order.
Prices do not include processing, delivery and shipping costs, which are specified before the order is validated.
ARTICLE 3 – Orders
Any order placed on the Site constitutes a remote contract between the Customer and the Seller. The order is considered accepted after validation of the full payment.
The Customer is solely responsible for the choice of products ordered. It can track the status of its order via its customer space.
The Seller reserves the right to refuse or cancel any order in case of prior dispute with the Customer.
ARTICLE 3 BIS – Customer Area
The creation of a customer account is mandatory to order. The Customer undertakes to provide accurate and up-to-date information. He is solely responsible for the confidentiality of his identifiers.
The Seller reserves the right to suspend or delete a customer account in case of non-compliance with the Terms and Conditions.
ARTICLE 3 TER – Nuances Club
The Nuances Club is a subscription program that allows for exclusive benefits throughout the subscription period. Membership is open to all adults.
Two options are proposed: - Annual subscription: EUR 46,80 (€ 3,90/month), with 2 months offered in the first year.
- Monthly subscription: €4.50/month, without obligation. Resustainable at any time by email, 15 days before the renewal date.
Advantages: -15% on the entire catalogue, free delivery from 6 bottles, advantageous sponsorship, cumulative offers, gift offered after 5 godly club members.
ARTICLE 3 QUATER – Loyalty Card
A dematerialized loyalty card is offered to all customers. It allows 5 % of the order amount to be added up to EUR 100 in vouchers valid for 30 days.
The Seller reserves the right to suspend or modify the program with a 30-day notice.
ARTICLE 4 – Payment
Payment is made online by credit card, Paypal or bank transfer. Payment is due on order. Transactions are secure.
Article 5 – Delivery
Delivery to metropolitan France and selected European countries. Average time: 2 to 5 working days. In case of delay of more than 14 days (not force majeure), the Customer can request cancellation of the order.
ARTICLE 6 – Transfer of ownership
Ownership of the products is transferred to the Customer after full payment. Risks are transferred when the package is physically delivered.
ARTICLE 7 – Right of withdrawal
The Customer has 14 days to retract. For Club membership, the right of withdrawal applies only if no advantage has been used.
Article 8 – Legal guarantees
The Seller is bound by legal guarantees of conformity (Consumer Code) and hidden defects (Civil Code). Defective products are reimbursed or replaced.
ARTICLE 9 – Personal data
Data are collected for order management and remain confidential. The Customer can exercise his rights (access, rectification, deletion) by writing to contact@adegas-terroirs.com.
ARTICLE 10 – Intellectual property
All content of the Site is protected by copyright. Reproduction is prohibited without prior authorization.
ARTICLE 11 – Applicable law – Dispute
The GTCs are subject to French law. In the event of a dispute, the Customer is invited to seek an amicable solution or to refer the matter to the competent courts.
